These Terms and Conditions ("Terms") govern your access to and use of the website located at https://www.drytrippingtravel.com and any related pages, content, features, and services made available by Dry Tripping Travel LLC ("Dry Tripping," "we," "us," or "our") (collectively, the "Platform"). Dry Tripping operates an online marketplace that connects users ("you" or "Users") with independent third-party providers ("Hosts") who offer travel experiences, trips, tours, accommodations, activities, and related services ("Experiences"). By accessing or using the Platform, creating an Account, or booking or paying for any Experience through the Platform, you agree to be bound by these Terms. By using the Platform, you represent that you are at least eighteen (18) years of age and are lawfully able to enter into contracts. If you do not agree to these Terms, do not use the Platform. Please read these Terms carefully, including the sections on assumption of risk, limitation of liability, and binding arbitration, which affect your legal rights.
Dry Tripping operates solely as a marketplace and intermediary that connects Users with independent third-party Hosts. Dry Tripping does not own, operate, manage, control, supervise, or provide any Experience, and is not a travel carrier, tour operator, hotel, or provider of any travel service. All Experiences are offered, arranged, and delivered by Hosts, who are independent contractors and are solely responsible for their Experiences, including their accuracy, quality, safety, legality, pricing, and fitness for any purpose. Any contract for an Experience is formed directly between you and the applicable Host. For bookings made through the Platform, Dry Tripping acts as the merchant of record and processes your payment as described in the Payments section below, but Dry Tripping is not otherwise a party to the contract for the Experience and does not provide the Experience itself. Your interactions and dealings with Hosts are solely between you and the Host. Where an Experience is described as alcohol-free, sober, or similar, that description is provided by the Host. Dry Tripping does not independently verify, monitor, or guarantee that any Experience, venue, accommodation, or activity is in fact alcohol-free, or that any Host prohibits, restricts, or enforces any rule concerning alcohol or other substances, and Dry Tripping is not responsible for a Host's failure to do so.
To use certain features of the Platform, you may be required to create an account using a username and password ("Account"). You are responsible for maintaining the confidentiality of your Account credentials and for restricting access to your Account, and you accept responsibility for all activities that occur under your Account. You agree to provide current, complete, and accurate registration, booking, and payment information, and to promptly update that information, including your email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. You may not assign or transfer your Account to any other person or entity. Bookings are for your own Account, and you may not book on behalf of, or submit the personal information of, any other person. We are not responsible for any loss arising from unauthorized use of your Account that results from your failure to safeguard your credentials.
The Platform allows you to browse Experiences listed by Hosts, communicate regarding Experiences, and book or request to book Experiences. Descriptions, availability, pricing, inclusions, and specific terms for each Experience are provided by the applicable Host on the relevant listing and are subject to change until a booking is confirmed. We do not independently verify, and we do not warrant, the accuracy or completeness of any listing or Host-provided information. When you book an Experience, you authorize the applicable payment and agree to the Host's listing terms, cancellation policy, and any additional requirements disclosed at the time of booking. We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice.
Dry Tripping does not charge you a fee to book through the Platform. Dry Tripping is compensated through a commission on your booking, which it retains from the amount you pay for the Experience, at no additional cost to you. The total price payable for an Experience is disclosed to you before you complete your booking. Host pricing, taxes, and any additional charges are set by the Host and disclosed at checkout. For certain listings that direct you to a Host's own or a third-party site to book, Dry Tripping may instead receive a referral fee in connection with your booking.
Payments for Experiences booked through the Platform are processed through our third-party payment processor. When you book, you may be required to pay a deposit, with the remaining balance due as stated on the listing, or the full amount, as disclosed at checkout. By booking, you authorize us and our payment processor to charge your selected payment method for the deposit at the time of booking and to automatically charge the same payment method for the remaining balance on the date it becomes due. You are responsible for ensuring your payment method remains valid through the balance due date. If the remaining balance cannot be charged when due, your booking may be cancelled in accordance with the applicable cancellation policy. For bookings made through the Platform, Dry Tripping acts as the merchant of record and receives your payment through the payment processor, retains its commission, and remits the balance to the Host. Dry Tripping holds any portion of your payment due to the Host, or refundable to you, solely for the purpose of remitting or refunding those funds, and not as its own. The contract for the Experience is between you and the Host, and Dry Tripping is not the provider of the Experience. Certain listings may direct you to a Host's own or a third-party site to book and pay for an Experience. For those bookings, payment is made on that site, the payment terms in this section do not apply, Dry Tripping is not the merchant of record and does not process or hold your payment, and the contract and payment are between you and the Host or third-party site.
Dry Tripping operates solely as an intermediary and does not provide, sell, or operate any Experience, transportation, lodging, or other travel service. Each Host is responsible for obtaining and maintaining any license, registration, permit, bond, or other authorization required for its Experience and for any transportation, lodging, or activity included in it, and for complying with all laws applicable to it. Dry Tripping makes no representation or warranty regarding any Host's licensing or regulatory compliance. Nothing in these Terms limits any right you may have under applicable law that cannot be waived.
Dry Tripping is registered as a seller of travel with the California Attorney General. Its California Seller of Travel registration number is CST 2173069-50. Registration as a seller of travel does not constitute approval by the State of California. California law requires certain sellers of travel to have a trust account or bond. This business has a bond issued by Westfield National Insurance Company in the amount of $10,000. Upon cancellation of an Experience (consisting of transportation or travel services), where the passenger is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed to and agreed to by the passenger, all sums paid to the seller of travel for services not provided will be promptly paid to the passenger, unless the passenger otherwise advises the seller of travel in writing after cancellation. This refund right is subject to the cancellation terms disclosed to you before booking, which govern cancellations you initiate. Dry Tripping is a participant in the Travel Consumer Restitution Fund. If you are located in California at the time you pay for an Experience, this transaction is covered by the California Travel Consumer Restitution Fund. California law provides that an eligible passenger who is owed a refund of more than fifty dollars ($50) for travel services that the seller of travel failed to provide or refund may file a claim with the Travel Consumer Restitution Corporation. The maximum amount that may be paid from the Fund to any one passenger is the total amount paid to the seller of travel on that passenger's behalf, not to exceed fifteen thousand dollars ($15,000). A claim must be submitted to the Travel Consumer Restitution Corporation within twelve (12) months after the scheduled completion date of the travel, together with a thirty-five dollar ($35) processing fee and sufficient documentation to support the claim. California law provides that a passenger who files a claim with the Fund thereby waives the right to bring a legal action against the seller of travel arising from the transaction that is the subject of the claim, except where the claim is denied on certain grounds specified by statute. You may obtain a claim form and further information from the Travel Consumer Restitution Corporation at www.tcrcinfo.org. If you are located outside California at the time you pay for an Experience, this transaction is not covered by the California Travel Consumer Restitution Fund.
For bookings made through the Platform, the following cancellation and refund schedule applies: (i) within forty-eight (48) hours after booking, you receive a full refund, including the deposit; (ii) after forty-eight (48) hours, the deposit is nonrefundable; (iii) sixty-one (61) or more calendar days before departure, all amounts paid beyond the deposit are refunded in full; (iv) thirty-one (31) to sixty (60) calendar days before departure, amounts paid beyond the deposit are refunded at fifty percent (50%); and (v) thirty (30) calendar days or fewer before departure, no refund is due. You are responsible for reviewing this schedule before you book. Deposits are nonrefundable except as provided in this schedule or as required by law. Refunds due for an Experience are the economic responsibility of the Host, and for bookings made through the Platform, Dry Tripping processes any such refund to you through the payment processor. For listings that direct you to a Host's own or a third-party site to book, all cancellation and refund matters are governed by that site's policies, and the schedule above does not apply. Dry Tripping may receive a referral fee in connection with bookings made through such listings. Nothing in these Terms waives or limits any refund or cancellation right that cannot be waived under applicable law. If you believe a charge is incorrect, you agree to contact us first so that we may attempt to resolve the matter. Initiating a chargeback or payment dispute without first attempting resolution, or for a charge that is valid under these Terms, may result in suspension or termination of your Account and recovery of any amounts owed. Nothing in these Terms limits any rights you may have under your card issuer's policies.
YOU UNDERSTAND AND ACKNOWLEDGE THAT TRAVEL AND PARTICIPATION IN EXPERIENCES CAN INVOLVE INHERENT AND OTHER RISKS, INCLUDING RISK OF ILLNESS, BODILY INJURY, EMOTIONAL DISTRESS, PROPERTY DAMAGE, AND DEATH, AND THAT THESE RISKS CAN ARISE FROM THE NATURE OF THE ACTIVITIES AND FROM THE ACTS OR OMISSIONS OF HOSTS AND OTHER THIRD PARTIES. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU VOLUNTARILY ASSUME ALL SUCH RISKS ASSOCIATED WITH YOUR BOOKING OF AND PARTICIPATION IN ANY EXPERIENCE. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE, AND DISCHARGE DRY TRIPPING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS (COLLECTIVELY, THE "COMPANY PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, LIABILITIES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO ANY EXPERIENCE OR THE ACTS OR OMISSIONS OF ANY HOST OR OTHER THIRD PARTY, WHETHER BASED ON NEGLIGENCE OR OTHERWISE. THIS RELEASE DOES NOT APPLY TO LIABILITY ARISING FROM DRY TRIPPING'S OWN GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR TO ANY LIABILITY THAT MAY NOT BE RELEASED OR WAIVED UNDER APPLICABLE LAW. YOU ARE ENCOURAGED TO OBTAIN APPROPRIATE TRAVEL AND MEDICAL INSURANCE AND TO CONFIRM THAT EACH HOST MAINTAINS ADEQUATE INSURANCE AND QUALIFICATIONS FOR ITS EXPERIENCE.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. The Platform may include reviews, messaging, or other interactive features. When using these features, you agree not to: (i) violate any law or the rights of others; (ii) post content that is false, defamatory, infringing, obscene, or harmful; (iii) upload files that contain malicious code or that violate intellectual property rights; (iv) use the Platform for unauthorized advertising or solicitation; or (v) impersonate any person or misrepresent your affiliation. We reserve the right, but not the obligation, to monitor, remove, or edit content and to suspend or terminate access for any violation of these Terms. To the extent you submit content to the Platform, you grant Dry Tripping a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and promoting the Platform. You are responsible for protecting your personal information when using interactive features. We may disclose information as required by law or to comply with legal process.
Dry Tripping retains all right, title, and interest in and to the Platform and its content, including all copyrights, trademarks, trade names, logos, and other intellectual property, excluding Host-provided and User-provided content. Subject to your compliance with these Terms, Dry Tripping grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use. You may not copy, modify, reverse engineer, scrape, resell, sublicense, frame, or remove any proprietary notices from the Platform. This license terminates automatically upon any violation of these Terms or upon termination of your access. The names, logos, and marks of Hosts and other third parties are the property of their respective owners.
The Platform connects you with independent Hosts and may contain links to third-party websites, content, or services, including Host sites and payment pages ("Linked Sites"). Linked Sites and Hosts are not under the control of Dry Tripping, and we are not responsible for their content, products, services, acts, or omissions. Links and listings are provided for convenience and do not imply endorsement. We make no representations or warranties regarding any Host, Linked Site, or third-party content, and your dealings with, and use of or reliance on, any Host or Linked Site are at your own risk.
You consent to receive communications from us electronically, including by email and through the Platform, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
Your use of the Platform is subject to our Privacy Policy, available at https://www.drytrippingtravel.com/privacy, which is incorporated into these Terms and describes how we collect, use, and disclose information.
You agree to indemnify, defend, and hold harmless the Company Parties from and against all third-party claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from: (i) your violation of these Terms; (ii) any activity related to your Account by you or any person using your Account; (iii) your booking of or participation in any Experience; or (iv) any other act or omission by you, but in each case only to the extent caused by your negligence, recklessness, or intentional misconduct. Your indemnification obligation is limited to your proportionate share of fault. This obligation survives termination of these Terms and your use of the Platform. In the event of a covered claim, you agree to (i) promptly notify us in writing, (ii) at our election, either assume the defense of the claim with counsel reasonably acceptable to us, or allow us to control the defense at your expense, with the non-controlling party entitled to participate at its own expense, and (iii) reasonably cooperate in the defense and settlement. If you assume the defense, you may not settle any claim in a way that imposes any obligation or liability on us, or requires any admission by us, without our prior written consent.
THE PLATFORM AND ALL CONTENT, EXPERIENCES, LISTINGS, AND INFORMATION MADE AVAILABLE ON OR THROUGH THE PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, DRY TRIPPING AND THE COMPANY PARTIES DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. DRY TRIPPING DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. DRY TRIPPING MAKES NO WARRANTY REGARDING ANY HOST, EXPERIENCE, OR THIRD PARTY, INCLUDING THE QUALITY, SAFETY, LEGALITY, OR SUITABILITY OF ANY EXPERIENCE OR THE CONDUCT, QUALIFICATIONS, OR INSURANCE OF ANY HOST. DRY TRIPPING DOES NOT WARRANT THAT ANY EXPERIENCE IS OR WILL BE ALCOHOL-FREE. ANY TESTIMONIALS OR REVIEWS REFLECT INDIVIDUAL EXPERIENCES AND DO NOT GUARANTEE SIMILAR RESULTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF DRY TRIPPING AND THE COMPANY PARTIES TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, WARRANTY, STATUTE, OR ANY OTHER LEGAL OR EQUITABLE THEORY, WILL NOT EXCEED THE GREATER OF (I) THE TOTAL COMMISSION OR REFERRAL FEE DRY TRIPPING RECEIVED IN CONNECTION WITH THE BOOKING GIVING RISE TO THE CLAIM, OR (II) ONE HUNDRED DOLLARS ($100). THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT. IN NO EVENT WILL DRY TRIPPING OR THE COMPANY PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR THE COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY AND UNDER ANY OF THE FOREGOING THEORIES. THESE LIMITATIONS WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THIS LIMITATION DOES NOT APPLY TO LIABILITY RESULTING FROM DRY TRIPPING'S GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY LIABILITY THAT MAY NOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Before initiating any formal proceeding, you agree to first contact us and attempt in good faith to resolve the dispute informally for at least thirty (30) days. Except as provided in this section, any dispute arising out of or relating to these Terms or the Platform that is not resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, before a single arbitrator. The arbitration will take place in San Francisco, California or, at your election, by telephone or video, and payment of arbitration fees will be governed by the AAA Consumer Arbitration Rules, with Dry Tripping paying the portion of fees those rules require it to bear. The arbitrator may award fees and costs, including arbitration fees, to the extent permitted by applicable law, including where the arbitrator finds that a claim or defense was frivolous or brought in bad faith. The arbitrator's award shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. YOU AND DRY TRIPPING AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS, AND EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION, WHETHER IN ARBITRATION OR IN COURT. This section does not prevent: (i) either party from bringing an individual claim in small claims court if it qualifies; (ii) you from seeking public injunctive relief, which shall be litigated in court and not in arbitration; or (iii) either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement or misuse of intellectual property rights or confidential information. YOU MAY OPT OUT OF THIS ARBITRATION AGREEMENT WITHIN THIRTY (30) DAYS OF FIRST ACCEPTING THESE TERMS BY EMAILING US AT THE ADDRESS IN THE CONTACT US SECTION WITH YOUR NAME AND A STATEMENT THAT YOU OPT OUT OF ARBITRATION. If you opt out, the agreement to arbitrate and the class action and jury trial waivers in this section will not apply to you, and any dispute will be resolved in court as provided below. Opting out does not affect any other provision of these Terms. Any dispute that is not subject to arbitration for any reason, including because you opted out, shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you and Dry Tripping consent to personal jurisdiction and venue there, except where applicable law entitles you to bring the claim in another forum.
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy and any policies incorporated by reference, constitute the entire agreement between you and Dry Tripping regarding the Platform and supersede all prior agreements. We may modify these Terms from time to time. If we make material changes, we will provide notice by updating the Effective Date below and, where appropriate, by other reasonable means. Your continued use of the Platform after the changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Platform. Any provision that by its nature should survive, including all payment obligations, the assumption of risk and release, warranty disclaimers, limitation of liability, indemnity, intellectual property, and dispute resolution provisions, survives any termination of these Terms, your Account, or your access to the Platform.
